Upon consideration of your request for an advisory opinion concerning whether you
may file suit in your own behalf because of an encroachment by an adjoining property
owner, it is the opinion of this Commission that you may file the suit in question under
the facts as set out in your request. Such action would not constitute a violation of
Canon 5F of the Alabama Canons of Judicial Ethics.
